Terms of Sale
These Terms of Sale govern consumer purchases of goods on maikinlife.com, operated by Niels DE BRUIJN EI, trading as Maikin. The version made available and accepted when you place your order applies to that order. Later changes do not alter an existing contract.
Translations and the choice of French law do not reduce mandatory consumer rights. Any ambiguity is interpreted in accordance with applicable consumer-protection law.

Maikin benefits from the French VAT exemption regime. VAT is not charged: “TVA non applicable, art. 293 B du Code général des impôts.”

2. Products
Maikin sells stationery, lifestyle accessories and related goods, including selected products from third-party manufacturers. Products are offered subject to availability.
Each product page describes the essential characteristics, such as dimensions, materials, colours and intended use. Please read these details before ordering.
Photographs and descriptions identify the products offered. Screen settings and lighting can cause minor colour differences. This does not affect our obligation to deliver goods conforming to the description or your statutory conformity rights.
3. Product safety and use
Use each product for the purpose described on its product page and follow any applicable manufacturer instructions and precautions supplied with it. Relevant safety information is supplied with the product information.
These instructions do not exclude our obligations as seller or any mandatory product-safety or consumer rights. The consequences of misuse or modification are assessed under applicable law.
4. Prices
Prices are displayed in euros. VAT is not charged under the French exemption regime described in section 1. Delivery charges are additional unless expressly included and are displayed before you place the order. The total amount payable is shown before final confirmation.
We may change prices for future orders. The price agreed when your contract is concluded applies to your order. Pricing or product-information errors are handled under section 5 and do not give us an unrestricted right to cancel an existing contract.
5. Placing and confirming an order
You can review your items, delivery and billing details, delivery method and total price, and correct errors before final confirmation. The final order action makes clear that the order entails an obligation to pay.
The contract is concluded after you accept these Terms and successfully complete payment. We send an order confirmation by email containing the required contractual information, the applicable Terms of Sale and withdrawal information in a form you can retain unchanged.
Before a contract is concluded, we may decline an order for an objectively justified legitimate reason, such as actual payment failure, a substantiated fraud concern or unavailability. We do not refuse consumer sales arbitrarily.
Once the contract is concluded, we perform it in accordance with these Terms and applicable law. If an error or fulfilment problem is discovered, we contact you promptly and explain the available resolution. Any cancellation must have a lawful basis or your agreement. A general stock or information-error clause does not remove your statutory remedies. Where cancellation requires a refund, we reimburse you within the applicable legal deadline.
For electronic contracts of €120 or more, we retain the contract from conclusion until delivery and for ten years after delivery. You can request access at support@maikinlife.com. Other records are retained for the applicable legal periods.
6. Payment
Payment is made online using the methods offered at checkout. Available methods are indicated at the beginning of the ordering process. The relevant payment provider processes payment details; Maikin receives the transaction information needed to administer your purchase, not your complete card number or security code.
Your order is processed after payment has been successfully confirmed.
7. Delivery
We currently deliver only to eligible addresses in metropolitan France, including Corsica. Delivery to French overseas departments and territories and to other countries is not offered at launch. Available methods and any address-specific charges are described in our Shipping Policy and shown before payment.
Orders are prepared and dispatched within 3 business days after payment confirmation, unless a different handling period is clearly stated before purchase. Delivery takes place no later than the end of the eighth business day after payment confirmation. Business days are Monday to Friday, excluding French public holidays.
Before you confirm your order, we indicate the delivery date or delivery period applicable to your selected method and destination, including preparation and transit. We deliver by that date or within that period. If no delivery date or period has been agreed, delivery takes place without undue delay and no later than 30 days after the contract is concluded.
If a delay arises, we inform you. This does not extend an agreed deadline without your agreement or remove your rights. If we fail to deliver on time, you may ask us in writing to deliver within an additional reasonable period. If we still do not deliver, you may terminate the contract. You may terminate immediately in the cases allowed by law, including where we refuse delivery or timely delivery was an essential condition disclosed before conclusion.
When you validly terminate for non-delivery, we reimburse all sums paid within 14 days of termination. A carrier investigation does not suspend these rights.
The risk of loss or damage remains with Maikin until you or your designated recipient physically receives the goods. If you independently appoint a carrier we have not offered, the statutory exception applies from handover to that carrier.
Please provide an accurate delivery address and contact us promptly if it needs correcting. If a parcel is damaged or missing, contact support@maikinlife.com. Photos or carrier reservations help where reasonably available, but failing to make reservations or report damage immediately does not by itself remove your rights.
If a parcel is returned because it was not collected or because you supplied incorrect delivery details, we contact you. Reshipment may be charged at its disclosed cost if you choose it and the failure was not caused by Maikin or the carrier. We do not charge an automatic penalty. Simply not collecting a parcel is not, by itself, an unambiguous withdrawal declaration.
8. Statutory right of withdrawal
For online consumer purchases, you may withdraw without giving a reason within 14 days after you, or someone you designate other than the carrier, take physical possession of the goods. For goods ordered together but delivered separately, the period runs from receipt of the last item. The receipt day is not counted. If the deadline falls on a Saturday, Sunday or public/non-working holiday, it extends to the next working day.
Notify us before that deadline by emailing support@maikinlife.com, posting an unambiguous statement to Niels DE BRUIJN EI — Maikin, 183 Allée des Cigales, 06600 Antibes, France, or using our online withdrawal feature: https://maikinlife.com/pages/droit-de-retractation. The model form in section 18 is optional. An order number or other evidence identifying your purchase is helpful.
When you use the online feature, we send an acknowledgement on a durable medium, such as email, without undue delay, including the content of your declaration and the date and time it was submitted. Withdrawal does not require our prior approval. Asking for return instructions does not postpone or shorten your deadline.
9. Returns and refunds
Send the goods back without undue delay and no later than 14 days after notifying us of withdrawal, to Niels DE BRUIJN EI — Maikin, 183 Allée des Cigales, 06600 Antibes, France. Keep evidence of sending.
You bear the direct return-postage cost for a change-of-mind return unless we agree otherwise. We bear the necessary return costs for a non-conforming, defective or incorrectly supplied product under your statutory rights.
Please return the goods complete and protect them appropriately during transport. Original packaging is helpful but is not a condition of statutory withdrawal. You may inspect the goods as necessary to establish their nature, characteristics and functioning. You are responsible only for diminished value caused by handling beyond that inspection, within the limits of the law. Opening packaging or reasonably inspecting a product does not automatically remove your right to withdraw.
We reimburse payments due without undue delay and within 14 days after you notify us. We may withhold reimbursement until we receive the goods or you provide evidence of sending them back, whichever happens first. This deferral does not apply where we offer to collect the goods ourselves.
For withdrawal from the whole order, we refund the goods and the cost of the least expensive standard outward delivery option we offered. We do not refund the extra cost of a more expensive delivery method you chose.
For a partial withdrawal, we refund the returned goods and any separable outward delivery charge attributable solely to them. Delivery charges that would have been the same for the goods you keep are not refunded.
We use the original payment method unless you expressly agree to another method without fees. Refunds are not conditional on discretionary approval. Your bank or payment provider may take additional time to display a reimbursement after it has been issued.
10. Exceptions and product problems
Statutory withdrawal exceptions apply only where allowed by law, including genuinely personalised goods and goods made to your specifications. Any applicable exception is disclosed before you order. Ordinary stationery is not excluded merely because its packaging is opened, and sale items retain statutory withdrawal and guarantee rights.
If goods are damaged, defective or incorrect, contact support@maikinlife.com. Order details and photos, where useful and reasonably available, help us investigate. Failure to contact us immediately or provide photos does not by itself remove statutory rights. For a different item, you may return the original under the applicable rules and place a new order; this does not affect a statutory right to replacement for non-conformity.
11. Legal guarantees

For new goods under French law, conformity defects appearing within two years after delivery are covered by the statutory framework and are presumed to have existed at delivery unless the law provides otherwise. You may request repair or replacement, subject to the legal conditions concerning impossibility or disproportionate cost. Bringing the goods into conformity must be free of charge, within 30 days of your request and without major inconvenience.
Where the legal conditions are met, including refusal, failure to remedy in time or a sufficiently serious defect, you may instead obtain a price reduction or terminate the sale and obtain a refund. A minor defect does not justify termination. Necessary return costs are borne by Maikin. These rights are independent of any withdrawal period or commercial guarantee.
A repair under the French legal conformity guarantee extends that guarantee by six months. If you request repair but the seller instead imposes replacement, a new two-year guarantee period starts on delivery of the replacement. The guarantee is suspended during the qualifying period when the goods are unavailable for repair or replacement.
The French guarantee against hidden defects may be invoked within two years of discovering the defect, under articles 1641–1649 of the Civil Code. It permits keeping the goods with a price reduction or returning them for reimbursement, where the legal conditions are met.
No additional commercial guarantee is provided by Maikin unless expressly stated for a product. Statutory rights remain unaffected.
The official French statutory guarantee notice is reproduced at the end of these Terms.
12. Liability
Maikin is responsible for proper performance of the distance-sale contract, including obligations carried out by providers we use. We may be released from liability, in whole or in part, only where we prove that non-performance or improper performance is attributable to the consumer, to the unforeseeable and insurmountable act of a third party unconnected with performance of the contract, or to force majeure, under applicable law.
No provision excludes or restricts liability or consumer rights that cannot lawfully be excluded or restricted.

We make reasonable efforts to respond as soon as possible. Please include enough information to identify the order or issue.
14. Consumer mediation
If a dispute remains unresolved after a written complaint to Maikin, you may refer it free of charge to our designated consumer mediator, subject to the statutory admissibility conditions:

The referral must be made within one year of your written complaint to Maikin. Mediation is voluntary and does not remove your right to bring a case before a competent court.
15. Personal data
Our Privacy Policy explains how we process personal data, the purposes and legal bases, recipients, retention periods and your rights. Accepting these Terms does not constitute consent to marketing or non-essential cookies.
The store is hosted by Shopify. Shopify processes information about your visits and purchases, including through enhanced services that incorporate your interactions with our store, other merchants and Shopify. Information is shared with Shopify and the service providers involved and may be processed in other countries. The Privacy Policy explains this processing, applicable consent choices, transfers and Shopify's separate privacy information.
16. Intellectual property
Website text, images, photographs, logos, graphics, designs and other protected content belong to their respective rights holders. Use beyond that permitted by law requires the relevant rights holder's authorisation. Exceptions permitted by law remain available.
17. Applicable law and courts
French law governs these terms. Where Maikin directs its activities to your country of habitual residence, this choice does not deprive you of the protection of mandatory consumer-law provisions that would otherwise apply.
Disputes may be brought before the courts competent under the applicable rules. These terms do not impose exclusive jurisdiction on the courts of Antibes or France. You may contact us to seek an amicable solution without prejudice to your legal remedies.

French statutory guarantee notice
Le consommateur dispose d'un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d'apparition d'un défaut de conformité. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité et non la date d'apparition de celui-ci.
Lorsque le contrat de vente du bien prévoit la fourniture d'un contenu numérique ou d'un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d'apparition de celui-ci.
La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.
La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d'une extension de six mois de la garantie initiale.
Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.
Le consommateur peut obtenir une réduction du prix d'achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;
4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n'a pas droit à la résolution de la vente si le défaut de conformité est mineur.
Toute période d'immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu'à la délivrance du bien remis en état.
Les droits mentionnés ci-dessus résultent de l'application des articles L. 217-1 à L. 217-32 du code de la consommation.
Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d'un montant maximal de 300 000 euros, qui peut être porté jusqu'à 10 % du chiffre d'affaires moyen annuel (article L. 241-5 du code de la consommation).
Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien.
