Privacy Policy
This policy explains how Niels DE BRUIJN EI, trading as Maikin, processes personal data when you visit maikinlife.com, place an order or contact us. It also explains Shopify's role and how to exercise your rights. Visiting the website or accepting the Terms of Sale does not constitute consent to marketing or non-essential tracking.
1. Who is responsible for your data
The controller for Maikin's retail activities is Niels DE BRUIJN EI, trading as Maikin, 183 Allée des Cigales, 06600 Antibes, France. SIREN: 102 184 728.
Contact us at support@maikinlife.com or +33 7 66 00 16 73 for privacy questions or rights requests. Shopify acts as a separate controller for certain processing described in section 5.
2. Information we process and its sources
We receive information directly from you, automatically when you use the store, and from providers involved in payment, shipping, customer accounts and store operation. Depending on your interaction, this includes:
* Contact and delivery information: your name, email address, billing and shipping addresses, and any phone number you provide.
* Order and transaction information: products ordered, amounts, payment status, transaction references, delivery and tracking details, returns, refunds and purchase history.
* Customer communications: your enquiries and the information you choose to provide when contacting us.
* Account and preference information: information associated with an account you use and choices such as language and cookie preferences.
* Technical and usage information: IP address, browser and device information, identifiers, pages visited, cart activity and interaction with the store, subject to the applicable cookie choices.
Payment-card information is handled by the relevant payment provider. Maikin receives the transaction information needed to administer your purchase, not your complete card number or security code. Authentication information is handled through the relevant account service; please do not send passwords or complete payment-card details to us by email.
Required fields are identified in the relevant forms. Without information needed to process or deliver an order, we may be unable to fulfil it. Optional marketing choices are not a condition of purchase.
3. Why we use information and the legal bases
Orders and requested services: we use necessary information to answer pre-purchase requests, process payment and delivery, provide account functions you request, send order messages and handle contractual returns. The basis is taking steps at your request before a contract or performing the contract (GDPR article 6(1)(b)).
Legal duties: we keep required accounting records, fulfil statutory consumer obligations and respond to lawful authority requests on the basis of a legal obligation (article 6(1)(c)).
Security and claims: we process proportionate information to secure the store, prevent fraud, manage non-contractual enquiries and establish or defend legal claims on the basis of our legitimate interests (article 6(1)(f)). These interests are balanced against your rights.
Optional marketing and tracking: where you subscribe to promotional messages or accept non-essential tracking, we rely on your consent (article 6(1)(a)). You may refuse or withdraw that consent without affecting purchases or the lawfulness of earlier processing. Shopify's separate processing is explained in section 5 and its own notice.
4. Who receives information
Information is accessible to Maikin and, to the extent needed for their tasks, providers involved in hosting, checkout, payment, shipping, communications and technical support. These include:
* Shopify, which hosts and operates the online store and provides associated services.
* Payment providers used for the payment method you select at checkout.
* Sendcloud and the carrier used for your delivery, for shipping information, labels, tracking and related support.
* Revoq (operated by BuschBytes), which processes the information submitted through our online withdrawal function and sends the required acknowledgement. Communications and storage providers are also used to handle enquiries and retain necessary business records.
We may also disclose necessary information to competent authorities where legally required, or to professional advisers and parties involved in resolving a dispute where there is an appropriate legal basis. Where a provider acts as an independent controller, its own privacy notice explains its separate processing.
5. Shopify and Network Intelligence
Our store is hosted by Shopify. Shopify collects and processes information about your access to and use of the store to provide and improve its services. Information you provide is shared with Shopify and the service providers involved, which may be located in countries other than where you live.
Shopify Network Intelligence is enabled. Its enhanced services can incorporate information from your interactions with Maikin, other merchants and Shopify to support services such as security, personalisation and advertising. For this separate processing, Shopify is responsible for responding to the relevant data-protection rights requests.
For visitors in the European Economic Area, we request consent before non-essential tracking and the related personalised advertising. You can decline or change your choices through our cookie controls. Shopify explains how it respects those choices and handles its other processing in its privacy information.
Read the Shopify Consumer Privacy Policy: https://www.shopify.com/legal/privacy/app-users. You can also use the Shopify Privacy Portal (https://privacy.shopify.com/en) to learn about and exercise your rights, including withdrawing consent or objecting to Shopify's relevant processing. You may always contact Maikin about data processed for our own retail activities.
6. Cookies and similar technologies
Required cookies support functions such as the cart, checkout, security and remembering privacy choices. Non-essential personalisation, marketing and analytics technologies are subject to your consent where required.
Our consent panel lets you accept all, decline all or choose categories. Non-essential categories are not selected in advance. You can reopen the cookie preferences through the “Privacy choices” link in the website footer and change or withdraw your choices.
Cookie lifetimes vary. Session cookies expire when the browser session ends; persistent cookies remain for their specified duration unless removed earlier. Shopify's Cookie Policy (https://www.shopify.com/legal/cookies), under “Merchant storefronts”, identifies its storefront cookies, their purposes and durations. It covers Shopify's platform and should not be read as a claim that every cookie listed is used on Maikin.
You can also delete or block cookies through your browser. Blocking required cookies may prevent cart, account or checkout functions from working correctly.
7. Marketing and order communications
We do not treat a purchase or the provision of an email address for an order as a newsletter subscription. If you choose to subscribe through a separate signup option, the signup explains the communications you will receive. You can unsubscribe using the link in each marketing email or by contacting support@maikinlife.com.
Unsubscribing from marketing does not stop messages needed to administer your order, delivery, return or account. Consent to marketing cookies is separate from consent to receive a newsletter.
8. How long we keep information
We keep operational order data for the time needed to fulfil your order and handle returns, guarantees and customer service. Revoq currently deletes withdrawal data from its service after 90 days under our plan; Maikin retains the confirmation email and any necessary correspondence for the applicable contractual, legal-evidence or dispute period described below. Records needed as legal evidence are retained with restricted access rather than reused for marketing.
Invoices and accounting supporting documents are retained for ten years from the close of the relevant accounting year. Electronic consumer contracts of €120 or more are retained from conclusion until delivery and for ten years after delivery, with access available on request.
Necessary contractual evidence and related correspondence may be retained for five years from the end of the relevant contractual relationship or the appropriate legal starting point. A longer mandatory period, an interrupted limitation period or an ongoing dispute can require longer retention of the relevant records.
If you subscribe to marketing, prospect information is retained for up to three years after collection or your last active contact. Customer marketing information is retained during the relationship and for up to three years after it ends, unless you withdraw consent or object sooner. The minimum suppression information needed to respect an objection is retained for at least three years and is not used to send marketing.
If you use a customer account, account information is retained while it is active, with an inactivity review after three years. Deleting an account does not require us to delete records we must retain for legal reasons. Cookie durations are described in section 6. Shopify's separate-controller retention practices are described in its own privacy notice.
9. International transfers
The store's data-storage hosting location is set to the European Union. This does not mean all processing by Shopify, payment providers or other service providers takes place exclusively in the EU.
Where personal data is transferred outside the European Economic Area, the applicable safeguards may include an adequacy decision or the European Commission's standard contractual clauses, with additional measures where necessary. You can contact support@maikinlife.com for information about the arrangements applicable to Maikin's transfers and how to obtain a copy of the safeguards, subject to legitimate redactions. Shopify's privacy information explains its own international processing.
10. Your rights
Subject to the conditions of the GDPR, you may request access to your data, correction, erasure, restriction of processing and portability. You may object to processing based on legitimate interests and withdraw consent at any time. You may object to direct marketing at any time. French law also allows instructions concerning the handling of your data after death.
Send your request to support@maikinlife.com. We respond without undue delay and normally within one month. If the complexity or number of requests requires up to two additional months, we explain the extension and its reasons within the first month. We may request proportionate information to verify identity when necessary.
You may lodge a complaint directly with the CNIL or another competent supervisory authority, including the authority in your country of habitual residence, work or the alleged infringement. Contacting Maikin first is not a prerequisite. Exercising your rights does not result in discriminatory treatment.
11. Security, children and external links
We use appropriate technical and organisational measures to protect personal data, taking account of the nature of the information and the risks. No system can guarantee absolute security. Please avoid sending unnecessary sensitive information in customer-service messages.
Our store is not directed at children. If you believe a child has provided information inappropriately, contact us so we can assess and address the request under applicable law.
Links to independent websites lead to services with their own privacy notices. This does not remove Maikin's responsibility for processing for which we are the controller.
12. Changes and contact
We update this policy when our practices or relevant requirements change and provide any notice required by law. Where new processing requires consent, a policy update alone does not replace that consent.
